The Supreme Court and You

There has been a lot in the news about our United States Supreme Court. All the news reports are important. First, I want to point out this is my opinion and not legal advice. Second, I am an American citizen very interested in maintaining democracy and the justice system.

The Supreme Court has been pivotal in many civil rights cases and criminal justice cases. One thing both have in common is how States Rights have neutralized the full effect of the ruling. One thing for sure, citizens exercise their right to go along or find away around it. Yes, given this informal forum, I am just having plain talk or in the legal profession, speaking in lamen terms.

One glaring example is the education system. Brown vs Board of Education was meant to integrate the school system with diversity. Instead, citizens moved away and created new communities and further divided the middle income class into three main groups. This ushered in the private school system. The debate in the 1970s and 1980s was if private schools were better than public schools. This would further go to evaluating the neighborhood the school was located.

Then religion based schools needed higher enrollment and parent tuition assistance. State and Federal agencies began to find ways to give tax money to religious based schools if the public schools were not meeting standards. This effectively lead to re-privatizing the education system.

In conclusion, yes the Supreme Court is very important to all of us. The United States justice system is complicated and is implemented in selective situations.
